Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“Policy”) sets out the rules governing use of the Daily Foodie platform (“Platform”) by Stores/Vendors and Customers. By registering as a Store or using the Platform as a Customer, you agree to comply with this Policy at all times.

2. Who may use the Platform

  • Stores must provide valid business registration details (or ID and proof of address for informal/sole proprietor traders) and complete Daily Foodie’s onboarding review before listing any Surprise Bags.
  • Customers must be at least 18 years old, or have permission from a parent/guardian, to place Orders.
  • Daily Foodie reserves the right to refuse, suspend, or terminate access for any user who does not meet these requirements.

3. Store obligations

Stores using the Platform must:

  • Comply in full with Daily Foodie’s Food Safety Guidelines for Stores (incorporated into this Policy by reference), including rules on food quality, storage, hot food handling, packaging, allergen disclosure, and collection procedures.
  • Only list food that is safe, correctly described, and accurately priced.
  • Disclose known allergens to Customers at or before collection.
  • Maintain basic records of items prepared for sale via the Platform, including quantities and category (e.g. bakery, produce, deli, dry goods).
  • Cooperate with Daily Foodie in the event of a food safety concern, complaint, or recall, including providing product or batch information where available.
  • Not misrepresent the origin, quality, use-by date, or value of any Surprise Bag.

4. Prohibited conduct

Users (Stores and Customers) may not:

  • Use the Platform for any unlawful purpose, or to sell or distribute food that does not comply with local food safety regulations.
  • Submit false, misleading, or fraudulent information during registration or onboarding.
  • Attempt to circumvent the Platform’s payment process (e.g. arranging off-platform payment to avoid fees or oversight).
  • Engage in abusive, threatening, or harassing behaviour toward other users, staff, or support representatives.
  • Submit fraudulent Orders, chargebacks, or refund requests.
  • Interfere with or attempt to disrupt the Platform’s operation, including through unauthorised access, scraping, or reverse engineering.
  • Use another user’s account without authorisation.

5. Reporting issues

Any safety concern, wrong item, damaged packaging, or customer complaint must be reported to Daily Foodie Support immediately via email: support@dailyfoodie.co.za.

Reports should include the date, Order number (if available), a description of the issue, and a photo where possible.

6. Consequences of violation

Where Daily Foodie determines, at its reasonable discretion, that a Store or Customer has violated this Policy, Daily Foodie may take any of the following actions, alone or in combination:

  • Issue a warning
  • Remove the relevant listing(s)
  • Suspend the Store or Customer account pending investigation
  • Withhold or reverse disbursement of funds relating to the affected Order(s)
  • Permanently terminate access to the Platform
  • Report the matter to relevant authorities where required by law

7. Investigation

Daily Foodie reserves the right to investigate suspected violations of this Policy, including reviewing Order records, communications, and relevant account information, and to take appropriate action based on the outcome of that investigation.

8. Changes to this Policy

Daily Foodie may update this Policy from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Policy.
